The Venezuelan social and human rights organizations that sign this statement reject the campaign of criminalization and discredit that the current authorities of the country are deploying against those who have cooperated with the Prosecutor’s Office of the International Criminal Court (ICC) on the preliminary examinations of the situation in the country.

The Venezuelan State is a signatory of the Rome Statute that created the International Criminal Court in 1998 and binds the authorities of the countries that recognize it to collaborate with the operation of the Court. Following complaints about serious human rights violations that occurred in the territory, the Office of the Prosecutor of the International Criminal Court announced in February 2018 the start of a preliminary examination to investigate possible crimes committed in Venezuela since April 2017. In February 2020, Nicolás Maduro requested the opening of an additional preliminary examination, known as “Venezuela II” to investigate alleged crimes against humanity that resulted from the application of unilateral coercive measures since 2014.

Since the beginning of the Preliminary Examination, different political and social actors have provided information to the ICC Prosecutor’s Office as inputs to decide whether or not to initiate a formal investigation into crimes against humanity committed in Venezuela.

In the framework of this process, Prosecutor Karim Khan paid a visit to the country on November 1 that ended with the closing of the preliminary examination and the start of the investigation phase. His presence in the country motivated an intense campaign of propaganda on the national system of public media. As reflected in a document released by the government under the title “Venezuela, a Guarantor of Human Rights”, one of the components of the campaign is the criminalization and discrediting of those who have submitted complaints, including human rights defenders.

The systematic State policy of restricting civic space in the country, including the work of the people that collaborate with international mechanisms for the protection of human rights, ratifies the lack of a genuine will to stop the situations that allowed crimes against humanity to occur in Venezuela. Also, this policy confirms the conclusions of the most recent report of the Independent Fact-Finding Mission regarding the profound irregularities in the justice administration system, which is used as an instrument to persecute dissent. Recent official announcements about new laws and reforms are not enough and only respond to the intention of the authorities to portray the existence of genuine and relevant mechanisms to administer justice in Venezuela. This campaign of discredit seeks to frighten the victims in order to inhibit them from continuing to share their testimonies.

–Hold the national authorities responsible for any action against the life, freedom, and integrity of those who are being criminalized for providing information to international mechanisms for the protection of human rights, especially to the Office of the Prosecutor of the International Criminal Court.

–Urge the Office of the Prosecutor of the International Criminal Court to monitor the threats and retaliation against those who have collaborated with its work, which also constitute a breach of the State’s obligations under the Rome Statute

–Invite the international community to continue following up on the human rights situation in Venezuela and strengthen the international mechanisms for the protection of human rights in the country, as they are the main containment for the abuse of power.
