The radio broadcast Derechos Humanos Pa Vos (Human Rights for you) from the Comisión para los Derechos Humanos del Estado Zulia (Commission for Human Rights of Zulia State, Codhez) held its first edition of 2020 by analyzing the current Venezuelan political scene after the election of the board of directors of the National Assembly ( AN) for the 2020-2021 session.

Lawyer and director of Acceso a la Justicia (Access to Justice) Alí Daniel was contacted via telephone to analyze the events that led to two parallel boards of directors and attacks on opposition deputies.

During the interview, Daniels highlighted the invalidity of the session in which Luis Parra was voted as president of the National Assembly, given that there was no quorum verification and that it was not allowed access to the president of Parliament, Juan Guaidó, who represents the official in charge of the revision of the quorum necessary for the election of the annual board of directors.

“That session must have been held with the absolute majority of the members of the National Assembly. The Constitution is clear, they must be members of the assembly and there must be a quorum of at least 84 deputies. Article 64 of the Constitution, numeral 1, states that the President of the Parliament is the one who requests the quorum review, and the Secretary has to verify it. None of this happened in the session where Deputy Luis Parra was voted. From the moment the quorum was not verified, that session, if it can be called that, is not valid,” Daniels explained.

On the other hand, the Director of Accesso a la Justicia said that only a third of the members of the AN supported the election of Luis Parra, so he questioned that he has the necessary majority to make decisions in Parliament, for example selecting a new independent National Electoral Council (CNE).

In this sense, Daniels stressed that what has been happening is part of a “continuous coup”, defined by Accesso a la Justicia as “the seizing of republican institutions to stay in power at any cost.”

Also, he said that the election that was made at the headquarters of El Nacional, where 102 deputies voted in favor of the re-election of Juan Guaidó as president of Parliament, was totally legitimate.
